Throughout the Site, the Terms “we”, “us” and “our” refer to Sneezums. We offer this Site, including all information, tools and Services available from this Site to you, the user, conditioned upon your acceptance of all Terms, conditions, policies and notices stated here.

By visiting our Site and/or purchasing or ordering something from us, you engage in our “Service” and agree to be bound by the following Terms and conditions (“Terms of Service”, “Terms”), including those additional Terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

We reserve the right at any time to modify or discontinue this Site (or any part or content thereof), at any time and for any reason , without notice to you and in acceptance of these Terms, you agree that we shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. Any new features or tools which are added to the current store shall also be subject to the Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by making those changes on this or any other relevant page on our Site. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Site following any changes constitutes acceptance of those changes. If you do not agree to any change to the Agreement then you must immediately stop using our Site.

Please read these Terms of Service carefully before accessing or using our Site as they affect your rights and liabilities and set out the Terms under which sneezums.co.uk makes products available to you, the customer. By accessing or using any part of the Site, you agree to be bound by these Terms of Service.

Any contract formed between ourselves shall be governed by English/UK Law and any dispute that may arise will be resolved exclusively in the Courts of England. We do not supply products or Services by mail order outside of the UK. If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

GENERAL CONDITIONS

We reserve the right to refuse Service to anyone for any reason and at any time. You understand that your information (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the Site through which the Service is provided, without express written permission by us.

The headings used in this Agreement are included for convenience only and will not limit or otherwise affect these Terms.

By agreeing to these Terms of Service, you agree that you will not use our products or Services for any illegal or unauthorized purpose. You must not transmit any worms or viruses or any code of a destructive nature.

TERMS OF SALE

  • All orders are subject to availability.
  • Prices shown are inclusive of VAT (unless otherwise stated) and are in GBP Sterling.
  • Delivery of orders is only possible within the UK. We are unable to deliver to BFPO, hotels or PO Box addresses.
  • Due to the additional postage costs for the postcodes detailed in our Delivery Policy, any large and/or heavy items/orders may incur an additional postage charge. If this is the case, once your order is received, we will contact you to discuss the additional charges. Please refer to the Delivery Policy for further details.
  • Whilst we have included images of all products, the images are not actual size, nor to scale. The colours within the images will also depend on your monitor’s display and colour capabilities, we will not be held liable for any colour discrepancies.
  • All orders will be dispatched by Royal Mail or UPS (unless otherwise agreed) – the carrier most suitable to your order will be determined at the sole discretion of Sneezums.

OUR CONTRACT WITH YOU

The information on the Site, including prices, does not constitute an offer to contract or enter into an Agreement. When you place an order and receive an order confirmation email from us your order shall constitute an offer for the products or Services selected. There is no binding contract between ourselves of any kind until your payment has cleared and the order has been dispatched. If, for any reason, we are unable to supply you with a product that you have ordered then we will have no other obligations to you, other than refunding you for that item.

MODIFICATIONS TO THE SERVICE AND PRICES

Product prices and descriptions are subject to change without notice and at the sole discretion of us and please note that prices may differ between those on our Site and those within our high street shop in Bury St. Edmunds.

The prices payable for the products that you order are clearly set out on our Site, unless that product is incorrectly priced. We reserve the right to discontinue any product at any time.

We take time and attention to detail to ensure that the content on our Site is correct and as accurate as possible. If, in error, we have incorrectly underpriced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item concerned.

All measurements are approximate and should there be any errors these are entirely unintentional. We have made every effort to display as accurately as possible the colours and images of our products that appear on our Site and we cannot guarantee that your device’s display of any colour will be accurate; we do not take responsibility if the colour of a product varies to what you expected.

All prices shown are in GBP and are inclusive of any VAT payable unless otherwise stated. Delivery charges are not included, these are displayed within the Delivery Policy and also shown within the checkout pages. The delivery option selected will be added to your final bill, inclusive of VAT.

Discounts and/or discount codes that may be offered are only applicable to the products and do not apply to delivery charges.

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.

CUSTOMER SERVICE

You are able to view your order by logging into your account. If you have a general query, have a look at our FAQs in the first instance as this may give you a quicker answer. If needed you can use the Contact Us form or email us at shop@sneezums.co.uk.

PRODUCT AVAILABILITY

If in the unfortunate circumstances we are, for any reason, unable to supply a particular product, we will notify you as soon as possible.

There may be occasions that we are able to meet your order requirement but with a delay to delivery or it could be that we are unable to supply that item at all. In the case of the latter we hope to be able to recommend an alternative product, or we will offer you a refund.

Contact will be made by phone and/or email using the details provided at the time that the order was made.

ACCURACY & PRIVACY OF BILLING AND ACCOUNT INFORMATION

From time to time you will be required to enter personal information to enable the functionality of the Site, for example to fulfill orders or to register for an account with us.

You agree to provide current, complete and accurate purchase and account information for all purchases made on our Site. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In the event that we make a change to or cancel an order, we will attempt to contact you by using the email and/or phone number provided at the time the order was made.

Information can be updated by signing into your account.

In order to prevent fraud you must keep your sign in details, particularly your username and password confidential and secure and must not disclose or share it with anyone.

Your submission of personal information through the store is governed by our Privacy Policy.

DELIVERY

Deliveries are only made within the UK and will be made to the address specified by the customer on completing your order. We are unable to deliver to BFPO, hotels and PO Box addresses.

Due to the additional postage costs for the postcodes detailed here (AB37-38, AB44-AB45, AB53-AB56, CA18-CA27, HS1-HS9, IM, IV14-IV28, IV30-IV32, IV36, IV40-IV56, IV7, IV9-IV12, KA27-KA28, KW, LA15-LA23, PA20, PA21-PA38, PA41, PA42-PA49, PA60, PA61-PA78, PA80-PA88, PH17-PH26, PH30-PH44, PH49-PH50, TR21-TR25, ZE), any large and/or heavy items/orders may incur an additional postage charge. If this is the case, once your order is received, we will contact you to discuss the additional charges. At this point you will be able to decide to proceed with the order by paying the additional charge, or we will refund your order. Smaller (by size and/or weight to despatch) are likely to be mailed by Royal Mail at no extra charge.

We use a combination of Royal Mail and UPS for our deliveries, so depending on the items ordered, Sneezums will determine the carrier at our sole discretion. You will receive an email to confirm which postal Service your item is being sent via, in addition to a tracking reference, where applicable. Where orders are of a small value, they may be dispatched via a service without a tracking reference.

Multiple orders to the same name and address may be packaged and distributed together.

Deliveries will be made between Monday and Saturday between the hours of 08:00 and 20:00, depending on the carrier. Please refer to the Delivery Policy for full details.

Sneezums usually deliver within 3-5 working days and we do our best to secure delivery within the time specified, however we shall not be held responsible for losses by delay in delivery arising out of any cause beyond our control. If we are aware that the delivery of your order will be delayed, we will notify you of the delay and an updated estimate of delivery date.

Should you wish to track your product please use the tracking reference provided to you, Contact Us or email us at shop@sneezums.co.uk if you have any concerns, so that we can investigate on your behalf and reply to you as soon as possible.

If you are not in when the delivery is attempted, at the discretion of the delivery driver, dependent upon the courier provider, your parcel may be left in a safe place, reattempted or taken to a collection point by Royal Mail or UPS. See Delivery Policy for further details. In regards to the latter, if you do not collect your parcel within the timeframe given and it is resent to Sneezums, you will be charged a £10 'return to sender' fee. This fee will be deducted from your refund of those items. If you still wish to receive your order then you will need to place another order and pay the appropriate delivery fee.

 

Delivery Timescales

During normal opening - Orders received by 12.00 midday on a Monday to Friday will be processed the same day. Orders received after 12.00 midday Monday to Friday or on a Saturday, Sunday or Bank Holiday, will be processed on the next working day.

We have kept our delivery pricing structure simple, as detailed below.

  • Orders over £50 (£50.01 and above) - Free Delivery
  • Orders £50 & under - £5.95
  • Click & Collect - Free of Charge
  • There may be occasions where delivery costs are removed or reduced as part of a promotion.

CANCELLATION OF AN ORDER

Please email shop@sneezums.co.uk to cancel or amend an order. Please note cancellations and refunds for such are at our discretion, however they will not be refused without just cause. In the event of a refund being given, we may still need to charge for the delivery of an order (including deliveries that qualify for free delivery), if that order has already been packaged and/or dispatched or if you do not notify us of your wish to cancel an order within 1 hour of placing your order.

RETURNS AND REFUNDS

If you wish to return an item, you will be responsible for any and all return postage costs. We recommend that you use an insured, tracked and signed for delivery service for all returns. Sneezums can not be held responsible for loss or damage of items when being returned.

There are certain items that are excluded from all refunds. We can not exchange or refund earrings, body jewellery, beauty products/cosmetics, items made to your specific measurements/requirements or personalised items, or special orders that were ordered especially for you and/or are not stock items. We also can not refund items that you have had personalised or altered. No refund or exchange can be given if the product has been manufacturer registered to a user and/or contains personal data.

For combination purchases (e.g. buy one get one free or buy one get another item at a reduced price) you must also return the free or reduced price items to enable an exchange or refund to be processed.

FAULTY OR DAMAGED PRODUCTS

At Sneezums we take pride in our products and services and carefully package all orders so that they are received in a good condition.

In the event of you receiving an order that has been damaged or is faulty, please submit a written summary and photographic evidence of all damage to the packaging and product to shop@sneezums.co.uk, together with your order number.

Damage to goods must be reported to Sneezums by 12:00 noon on the day following receipt of the delivery. Sneezums will review the evidence and where possible provide a replacement of the damaged item. Please be aware that we must receive the return of the damaged goods before we can send a replacement. Sneezums will check the returned damaged goods before we are able to process a replacement. If stock availability does not allow a replacement product we will offer a refund at the price paid. We will not give a refund on damaged goods that you have tried to repair. If the damaged item was the only item within your order then we will also refund delivery costs if applicable, however if the item was ordered alongside other items then the delivery costs will not be refundable.

If an item is faulty, please email us to shop@sneezums.co.uk within 30 days from receipt of the item, so that we can arrange for a pre paid label to be sent to you and also a replacement or a full refund including the standard delivery charge if applicable. Please be aware that we must receive the return of the faulty goods before we can send a replacement or process a refund. Sneezums will check the returned faulty goods before we are able to process any replacement or refund. We will not give a refund on faulty goods that you have tried to repair. If the faulty item was the only item within your order then we will also refund delivery costs if applicable, however if the item was ordered alongside other items then the delivery costs will not be refundable.

If you have had your product repaired or altered anywhere other than Sneezums, your guarantee is immediately invalid. To protect a guarantee, all work must be carried out by or via / through Sneezums.

PAYMENT

We use Shopify Payments for all our transactions on our Site and through this we accept the following secure payment methods:
  • Mastercard Debit or Credit Card
  • Visa Debit or Credit Card
  • American Express


Shopify Payments are PCI compliant and 3D Secure, making buying online safer and reducing fraudulent transactions. Your credit or debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order.

Our liability in relation to any order will not exceed the total price charged for the relevant items (including VAT) and the delivery charge. Sneezums will not be held liable for any loss you may suffer if a third party procures unauthorised access to any data that you provide in using Shopify Payments.

LINKS TO OTHER SITES

Our Site may contain links to other Sites of interest. Once you have used these links to leave our Site you should note that we do not have any control over that other Site. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or Sites, or for any other materials, products, or Services of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party Sites. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

OPTIONAL TOOLS

We may provide you with access to third-party tools and use third-party apps, over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools and apps ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the Site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the Terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new Services and/or features through the Site (including, the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If, at our request or otherwise, you send certain specific submissions (for example contest entries, general customer experience feedback, suggestions, creative ideas or other materials) whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related Site.

You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments.

You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our Site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, availability, delivery charges and delivery timescales.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related Site is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related Site, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related Site, should be taken to indicate that all information in the Service or on any related Site has been modified or updated.

COMPLAINTS

In the unlikely event that you wish to make a complaint, these should be emailed to shop@sneezums.co.uk or submitted via a Contact Us form. All complaints will be taken seriously and will be investigated as soon as possible, on receipt of a complaint.

COMPETITION RULES & PRIZES

From time to time we may run competitions and prize draws either on our website or across social media platforms. The following Terms & Conditions will apply, unless we have stated otherwise and all entrants will be deemed to have accepted these terms:

  • The promoter is Sneezums, 10 Cornhill, Bury St. Edmunds, Suffolk, IP33 1BH
  • All competitions and prize draws are not open to any member of staff of Sneezums or their immediate family member or any of our suppliers.
  • All will only be open to residents of the UK.
  • Postal entries must be sent to Sneezums, 10 Cornhill, Bury St. Edmunds, Suffolk, IP33 1BH. You must provide us with your name, address, phone number and the details of the competition that you are entering. Illegible entries will be deemed void.
  • Sneezums will not take responsibility for any entries that are lost, delayed or have paid insufficient postage or damaged in the post – proof of postage will not be accepted as proof of entry.
  • Once received, all entries will be the property of Sneezums and will not be returned under any circumstances.
  • One entry per person only. Multiple entries from one person will be removed entirely.
  • All personal data provided must be factually correct and accurate.
  • For prize draws, the winner(s) will be chosen at random from all valid entries. Winners agree that Sneezums will be allowed to notify them of winning within 30 days of the closing date, via email or telephone.
  • If the winner does not respond to Sneezums within 14 days of the competition winner being announced, the prize may be reallocated to another entry. This will be at the sole discretion of Sneezums.
  • Competition and prize draw winners agree to participate in any future publicity run by Sneezums or it’s suppliers.
  • You agree that should you win, your first name, town and product information may be published on our Site and / or our social media. You also agree that Sneezums is able to use any images and text that you have submitted.
  • Entrants that did not win are able to request the first name and town of the winning entry by sending a stamped addressed envelope to Sneezums, 10 Cornhill, Bury St. Edmunds, Suffolk, IP33 1BH.
  • All prizes are subject to availability. Sneezums retain the right to alter the prize, should the need arise, with a prize that is of a similar or high value to that originally promoted.
  • No cash alternatives will be available, including cash or credit. Prizes are non-transferable, non-refundable, non-exchangeable.
  • Delivery of the prize will be at the cost of Sneezums, unless the winner’s delivery address is included in the areas that may incur additional postal charges or is an address of those addresses included in delivery exceptions.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. In no case shall Sneezums, our directors, partners, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our Site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this Agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

ENTIRE AGREEMENT

This Agreement governs our relationship with you. The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this Site or in respect to The Service constitutes the entire Agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous Agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
